Man Convicted Because of Pictures, Not Having Sex with 17-year old

The Illinois Supreme Court ruled on Thursday that a crime wasn’t committed when a 32-year old man had sex with a 17-year old girl, but the pictures he took crossed the line.

The man, Marshall Hollins, was arrested in March 2009 and charged with three counts of child pornography, but not statutory rape. The age of consent in Illinois is 17, but it is illegal to photograph anyone under the age of 18 engaged in a sexual act.

Hollins was convicted in 2010 and sentenced to eight years in prison, but appealed his conviction. After a 5-2 ruling, the high court upheld his sentence.
